Illegal Government Action Hurts All of Us
On July 10, 2007, in spite of much public opposition, the Prince William Board of County Supervisors in Virginia passed a resolution - Resolution No. 07-609 - purportedly aimed at addressing the "economic hardship and lawlessness" caused by the presence of undocumented immigrants in Prince William County, Virginia.

In an effort to discourage undocumented immigrants from residing in Prince William County, the resolution requires all Prince William County police officers to inquire into the citizenship or immigration status of a person detained for a violation of any state law or county ordinance if the officer has "probable cause" to believe that the person is in violation of federal immigration law. The resolution also contemplates that the County will begin to restrict access to certain public benefits solely to those who can demonstrate that they are lawfully present in the United States.

The Resolution Is Unconstitutional
The power to regulate immigration is unquestionably reserved to the federal government. Furthermore, when the federal government establishes statutory rules and regulations concerning the rights, privileges, and obligations or burdens of aliens, the statute and regulations are the supreme law of the land. The resolution is unconstitutional because the resolution passed by the Prince William Board of County Supervisors is nothing more than a blatant attempt to regulate immigration and interfere with a federal regulatory scheme that the County has deemed ineffective.
